Terms of service
These terms cover your use of www.dlaexpert.co.uk ("the service"), run by Karol Slusarczyk trading as Benefits Expert ("we", "us"). By using the service or buying a report, you agree to them.
1. What we provide
DLAexpert helps parents and carers describe a child's needs on the Disability Living Allowance (DLA) claim form for a child under 16 (DLA1 Child). Our products are:
- Free preview: one area of the form written for your child, free.
- Full Report (£49.99): the form question by question with what to tick and the numbers to write, lines to adapt for the more information boxes, guidance for each area and an evidence plan.
- Done For You (£99.99): the form question by question with the text written for every more information box, the day and night care table, the evidence plan and letters for the GP and the school.
- Mandatory Reconsideration Pack (£149.99): grounds to challenge a DLA decision part by part, a mandatory reconsideration letter and the full Done For You report.
All prices are one-off payments in pounds sterling. There are no subscriptions.
The DLA claim form we follow is the one used in England and Wales. In Northern Ireland, DLA for children is run by the Department for Communities and the form follows the same structure. In Scotland, new claims for children are Child Disability Payment from Social Security Scotland, so the service does not apply there.
2. Guidance only
DLAexpert gives guidance only. It is not legal, medical or benefits advice. We are not a law firm or a charity and we are not part of or linked to the Department for Work and Pensions (DWP).
Our guidance is based on the DLA rules and the official claim form and notes, but we cannot promise any outcome. The DWP decides every claim. For formal advice, you can contact Citizens Advice, a welfare rights adviser or a solicitor who specialises in benefits law.
3. How the service works
You tell us about your child's conditions and how they affect them by day and at night. Our system uses this to write guidance and answers that follow the claim form. Your report is shown on screen after payment, emailed to you and can be saved as PDF files. It is unique to the information you give.
4. Your responsibilities
You agree to:
- give accurate and truthful information about your child
- use the report to describe your child's real needs, never to exaggerate or invent them
- read the report and change anything that does not fit your child before you send the form
- not resell or share the report with others for commercial purposes
5. Payment and delivery
Payments are handled securely by Stripe. We never see or store your card details. When your payment goes through, you are taken back to the site to fill in your child's details. Your report is written as soon as you send them, at any time within 36 hours of payment (the life of your order link), and it is also emailed to you.
6. Cancellation and refunds
Your report is digital content made for you. When you pay, you ask us to supply it within the 36 hours of your order link and you acknowledge that you lose your 14-day right to cancel once the report has been written, as the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 allow for digital content. The payment page says this above the pay button. If you have paid but not yet sent your child's details and want to cancel, write to us and we will refund you.
If something goes wrong on our side (for example you paid but your report was not written or did not reach you), email support@benefitsexpert.co.uk and we will put it right or give you a full refund. If you paid but live in Scotland, where the DLA form does not apply to new claims for children, write to us for a refund. This does not affect your statutory rights.
7. Data and privacy
The health information you give us about your child is special category personal data under Article 9 of UK GDPR. We process it under Article 9(2)(a), explicit consent, which you give by ticking the consent box before we write your answer or your report. What you enter is not kept on our application servers after the report is written. You can withdraw consent or ask us to delete your data at any time by emailing support@benefitsexpert.co.uk. Our privacy policy has the details: the data controller, the processors, cookies, your rights and how to complain to the ICO.
8. Intellectual property
The DLAexpert website, branding and technology belong to us. Your report is for your own use for your child's claim. You may share it with advisers, support workers, professionals or family members who are helping you with the claim.
9. Limitation of liability
As far as the law allows:
- we are not responsible for the outcome of your child's claim
- we are not responsible for decisions the DWP makes
- our total liability to you for any claim about the service is limited to the amount you paid
Nothing in these terms limits our liability for fraud, for death or personal injury caused by our negligence, or for anything else that cannot be excluded by law.
10. Changes to these terms
We may update these terms from time to time. The date at the top shows when they last changed. The terms in force when you bought your report apply to that purchase.
11. Governing law
These terms are governed by the law of England and Wales. If you live in Scotland or Northern Ireland, you can also bring a claim in the courts where you live.
